Terms of Service

Welcome to dbtrail.com (together with any related websites, the “Site”). The Site is owned and operated by dbtrail (“dbtrail”, “we”, “us”, or “our”). Through the Site, dbtrail provides a cloud-hosted continuous data protection and change intelligence service for MySQL databases, as well as related tools, APIs, and documentation (the “Service”). Please read these Terms of Service (these “Terms”) carefully before using the Site or the Service.

By accessing or using the Site or the Service you agree to be legally bound by these Terms. If you do not accept these Terms, do not use the Site or the Service.

Account Terms

You are responsible for maintaining the security of your account and password. dbtrail cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted and activity that occurs under your account, including activity by other users who have their own logins under your account. You may not use the Service for any illegal purpose or to violate any laws in your jurisdiction. You must provide a valid email address and any other information requested to complete the signup process. Your login may only be used by one person; a single login shared by multiple people is not permitted. You may create separate logins for as many people as your plan allows. Accounts registered by automated methods (“bots”) are not permitted.

Service Description

The Service consists of continuous MySQL binlog indexing, change history querying, recovery SQL generation, forensic attribution, and related capabilities. The Service is accessible through a web dashboard, a REST API, and an MCP (Model Context Protocol) Gateway.

dbtrail offers two deployment modes:

  • Cloud mode: The binlog capture agent connects directly to your MySQL server or via SSH jumphost. Indexed data is stored in dbtrail-managed infrastructure.
  • VPC mode (“dbtrail in your VPC”): The capture agent and indexed data remain entirely within your infrastructure. Only structural metadata (schema information, event counts, timestamps) is transmitted to dbtrail. Your MySQL credentials, SSH keys, and row-level data never leave your environment.

Regardless of deployment mode, all recovery SQL generated by dbtrail is provided in dry-run mode by default. dbtrail does not execute any statements against your database unless you explicitly choose to do so.

Open Source Agent

The bintrail capture agent is open source software licensed under the Business Source License 1.1, with a four-year change date to Apache 2.0. The bintrail agent is governed by its own license terms, available at github.com/dbtrail/bintrail. Your use of the bintrail agent is subject to those terms, which are separate from these Terms.

API and MCP Terms

You may access the Service programmatically via the REST API and MCP Gateway. Any use of these interfaces, including use through third-party tools (such as AI assistants, IDE extensions, or automation platforms), is bound by these Terms. You expressly understand and agree that dbtrail shall not be liable for any damages or losses resulting from your use of the API, MCP Gateway, or third-party integrations. Abuse or excessively frequent requests may result in temporary or permanent suspension of your access. dbtrail will make a reasonable attempt to warn the account owner before suspension.

Plans, Payment, and Billing

The Service is offered under multiple plan tiers, including a free tier. Details of current plans, features, and pricing are available at dbtrail.com/pricing.

For paid plans, fees are billed in advance on a monthly or annual basis. All fees are exclusive of taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment of all such taxes.

Any upgrade or downgrade in plan level may result in prorated charges or credits. Downgrading your plan may cause the loss of features or capacity. dbtrail does not accept liability for such loss.

Free Tier

The free tier is provided at no cost with limited capabilities (one server, Cloud mode only, shared infrastructure). dbtrail reserves the right to modify, limit, or discontinue the free tier at any time with 30 days notice.

Cancellation and Termination

You may cancel your account at any time by contacting support@dbtrail.com or through the account settings in the dashboard.

Upon cancellation, your access to the Service will end immediately. All indexed data, configuration, and account information will be permanently deleted within 30 days. This information cannot be recovered once deleted.

If you cancel before the end of a paid billing period, the cancellation takes effect immediately and you will not be charged again. No prorated refunds are provided for unused time in the current billing cycle.

dbtrail, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time. dbtrail reserves the right to refuse service to anyone for any reason at any time.

Your Data

You retain all rights to the data you provide to the Service, including your MySQL binlog data, database schemas, and any other content transmitted through the capture agent.

In VPC mode, your database credentials, row-level data, and binlog payloads never leave your infrastructure. dbtrail receives only structural metadata necessary to provide the Service.

In Cloud mode, binlog data is transmitted to and stored in dbtrail-managed infrastructure. dbtrail processes this data solely to provide the Service and does not access, use, or share your data for any other purpose.

Upon termination of your account, all stored data is deleted within 30 days in accordance with the Cancellation section above.

Modifications to the Service and Prices

dbtrail reserves the right to modify or discontinue, temporarily or permanently, any part of the Service, with or without notice. Prices are subject to change upon 30 days notice. Such notice may be provided by posting changes to the Site or by email.

dbtrail shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

Intellectual Property

The Site and the Service, including all software, designs, documentation, and content created by dbtrail, are protected by intellectual property laws. As between you and dbtrail, dbtrail owns and retains all rights in the Site and the Service. dbtrail grants you a limited, revocable, non-sublicensable license to access and use the Service for your internal business purposes in accordance with your plan.

You may not copy, modify, reverse engineer, or create derivative works based on the Service, except as expressly permitted by these Terms or by the open source licenses governing the bintrail agent.

Disclaimer of Warranties

The Service and the Site are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by applicable law.

dbtrail does not warrant that: (a) the Service will meet your specific requirements, (b) the Service will be uninterrupted, timely, secure, or error-free, (c) the results obtained from the Service will be accurate or reliable, or (d) any errors in the Service will be corrected.

Recovery SQL generated by the Service is provided for review purposes. dbtrail does not guarantee that generated SQL will be correct, complete, or safe to execute in your environment. You are solely responsible for reviewing and validating any SQL before execution against your database.

Limitation of Liability

To the fullest extent permitted by applicable law: (a) in no event shall dbtrail, its affiliates, or their respective employees, contractors, agents, officers, or directors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to the use of the Service or the Site; and (b) in no event shall dbtrail's cumulative and aggregate liability under these Terms exceed the amounts paid by you to dbtrail in the twelve (12) months preceding the event giving rise to the claim, or two hundred U.S. dollars ($200), whichever is greater.

Indemnification

You agree to indemnify and hold harmless dbtrail and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service, (b) your violation of these Terms, or (c) your execution of any SQL or other operations generated by or derived from the Service against your databases.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to the choice of law rules of that State. Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Delaware, and the parties expressly consent to personal jurisdiction and venue in those courts.

Miscellaneous

These Terms constitute the complete agreement between the parties regarding the Service and supersede all prior proposals and communications. If any provision of these Terms is held invalid or unenforceable, the remainder shall continue in full force and effect. dbtrail's failure to enforce any right or provision of these Terms shall not be a waiver of that right or provision. You may not assign your rights or obligations under these Terms without dbtrail's prior written consent. dbtrail may assign its rights and obligations without restriction.

Changes to These Terms

dbtrail may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Site or by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
