Terms of Service

The Software

The Software is open source and licensed under the Apache License, Version 2.0. Its license terms are available at github.com/dbtrail/dbtrail. Your use of the Software is governed by that license, which is separate from these Terms. Where the two differ about the Software, the license controls.

You install and run the Software on infrastructure you control. dbtrail does not host, operate, or have access to your installation, your databases, or the data the Software records.

The Software generates recovery SQL as text for you to review. It does not execute statements against your database.

Use of the Site

You may not use the Site for any illegal purpose or to violate any laws in your jurisdiction. You may not interfere with the operation of the Site, attempt to gain unauthorized access to it, or send it abusive or excessively frequent automated requests.

Your Data

The data the Software records, including database changes, schemas, and backups, stays on the infrastructure you run it on and in the storage you configure. dbtrail does not receive it.

Official release builds of the Software send metadata-only usage statistics, which you can turn off. What is sent, what is never sent, and how to turn it off are described on the telemetry page and in our Privacy Policy.

Modifications to the Site and the Software

dbtrail reserves the right to modify or discontinue, temporarily or permanently, any part of the Site, with or without notice. New versions of the Software may add, change, or remove features. Versions already released remain available under their license.

Intellectual Property

The Site, including its designs, documentation, and content created by dbtrail, is protected by intellectual property laws. The DBTrail name and logo are trademarks of dbtrail; the Apache License does not grant permission to use them, except as required to describe the origin of the Software.

Disclaimer of Warranties

The Site and the Software are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by applicable law.

dbtrail does not warrant that: (a) the Site or the Software will meet your specific requirements, (b) the Site will be uninterrupted, timely, secure, or error-free, (c) the results obtained from the Software will be accurate or reliable, or (d) any errors will be corrected.

Recovery SQL generated by the Software is provided for review purposes. dbtrail does not guarantee that generated SQL will be correct, complete, or safe to execute in your environment. You are solely responsible for reviewing and validating any SQL before execution against your database.

Limitation of Liability

To the fullest extent permitted by applicable law: (a) in no event shall dbtrail, its affiliates, or their respective employees, contractors, agents, officers, or directors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to the use of the Site or the Software; and (b) in no event shall dbtrail's cumulative and aggregate liability under these Terms exceed two hundred U.S. dollars.

Indemnification

You agree to indemnify and hold harmless dbtrail and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site, (b) your violation of these Terms, or (c) your execution of any SQL or other operations generated by or derived from the Software against your databases.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to the choice of law rules of that State. Any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Delaware, and the parties expressly consent to personal jurisdiction and venue in those courts.

Miscellaneous

These Terms constitute the complete agreement between the parties regarding the Site and supersede all prior proposals and communications. If any provision of these Terms is held invalid or unenforceable, the remainder shall continue in full force and effect. dbtrail's failure to enforce any right or provision of these Terms shall not be a waiver of that right or provision.

Changes to These Terms

dbtrail may update these Terms from time to time. We will post the updated Terms on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
